Comment on Copyright Board of Canada Tariff Decision for Schools
On June 26, 2009, the Copyright Board released its decision on the 2004 Access Copyright application to the Board for a tariff that would address the copying of the works in its repertoire; extensive negotiations with the education sector on fair compensation for copying of that repertoire in elementary and secondary schools ended in deadlock.
The Board set a royalty tariff of $5.16 for each full-time equivalent (FTE) student, a significant increase from the current tariff of approximately $2.45 per FTE student.
We acknowledge the Board's thorough and thoughtful analysis of all evidence presented in this complex and arduous process.
The decision considered the scope of the fair dealing exception in the educational setting. The decision's major findings and first principles with respect to uses of copyright material will be analyzed in the coming weeks.
