WIPO Treaties and Canadian Copyright Legislation

Canada became a signatory on the WIPO Copyright Treaty and the WIPO Performances and Phonograms Treaty of December 1996.  To date Canada has not upgraded its copyright legislation to permit ratification of these agreements. 

Key issues necessary to implement the WIPO treaties:

  1. “making available right” and effective remedies for infringement,
  2. Database protection (minimum “sui generis” protection), and
  3. Legal protection of technological measures

TRIPs proceeding against China

Canada has joined in the Consultations by the United States on China and Measures Affecting the Protection and Enforcement of Intellectual Property Rights, commenced April, 2007
